4. Verify with the park before you rely. Prices, hours, seasons and slide line-ups change — sometimes daily.
5. Your consumer rights are unaffected. Your rights under your state’s UDAP statute apply to your transaction with the park, not with us.
6. Our content is general information. The park’s own page is authoritative.
7. Statutory liability is preserved. Nothing limits liability that cannot be excluded under applicable law.

1. Nature of the Site
waterparkusa.org/ is an independent editorial publisher of a U.S. water-park directory. We are NOT:
- the U.S. Consumer Product Safety Commission (CPSC) or any federal safety regulator
- the Centers for Disease Control and Prevention (CDC) or the authors of the Model Aquatic Health Code (MAHC)
- any state or local health department or amusement-ride safety program
- the World Waterpark Association (WWA), IAAPA, the Pool & Hot Tub Alliance (PHTA), or the National Recreation and Park Association (NRPA)
- the American Red Cross, Ellis & Associates, StarGuard ELITE, or any lifeguard-certification body
- ASTM International or any standards-development organization
- the Federal Trade Commission (FTC) or any state Attorney General

2. Not the Park, Not a Substitute for the Park
For anything specific to your booking, your tickets, your season pass, your refund, your cabana, your locker, or any account matter, the route is the park itself — not waterparkusa.org/.
We describe parks. We do not act as a park. We do not have access to park ticketing systems. We cannot look up a booking, process a refund, or change a reservation. The protected route to your booking is the park’s own customer service line, online portal, or in-person guest services.
3. Your Consumer-Rights Position — State UDAP & Federal Routes
When you buy a ticket or season pass at a U.S. water park, your contract is with the park (or its parent operator). Your state's Unfair and Deceptive Acts and Practices (UDAP) statute — for example, the California Consumers Legal Remedies Act, the New York General Business Law §349/350, or the Massachusetts Chapter 93A — and federal consumer-protection law (FTC Act Section 5) protect you against deceptive or unfair practices. waterparkusa.org/ is not party to that transaction. If a park engaged in a deceptive or unfair practice, raise it with the park first; if unresolved, contact your state Attorney General, the Better Business Bureau at bbb.org, and the FTC at reportfraud.ftc.gov. For credit-card purchases, you may also have chargeback rights under the Fair Credit Billing Act through your card issuer.
4. Not Legal, Medical, Safety, Financial, or Insurance Advice
Nothing on this site is legal, medical, safety, financial, insurance, tax, or other professional advice. For specific advice, consult an appropriately licensed U.S. professional. In particular, our attraction descriptions and slide notes are not safety advice. Always follow park staff and lifeguard instructions, posted height/age/weight limits, and posted rules. The CDC’s Model Aquatic Health Code is written for operators and health departments, not visitors.
5. Public Information and Limits on Its Use
U.S. water-park details — address, customer phone, operator name, hours, published pricing — are public information, published by the park itself and its operator. That public status does not eliminate all restrictions on use of our editorial content:
- Copyright (17 U.S.C. §101 et seq.) applies to our original editorial work
- Lanham Act (15 U.S.C. §1051 et seq.) applies to use of operator and parent-company marks
- State UDAP statutes and FTC Act Section 5 apply to commercial practices
Public ≠ unrestricted.
6. Accuracy and the Verification Caveat
We work to a strict human-verification standard — every URL clicked, every phone dial-tested quarterly, every price and operator attribution cross-checked. We are nevertheless an editorial publisher, not the park or the regulator. U.S. water-park details change frequently — admission prices change every season, calendars shift, slides come in and out of service for renovation, and parks change hands through acquisition (for example, the consolidation of major operators in recent years has moved many parks between parent companies).
If a detail on our site and the park’s own published page disagree, the park’s page is authoritative. Tell us — we re-verify and update.
7. Third-Party Content and Links
The site links extensively to the CPSC, the CDC, the WWA, IAAPA, the PHTA, individual parks, operator websites, parent-company websites, state and local health departments, the FTC, state Attorneys General, and other third-party sites. We do not control those sites and are not responsible for their content, availability, accuracy or privacy practices. A link is not an endorsement.
8. U.S. Regulatory Framework Reminder
U.S. water-park safety is layered: the CPSC administers federal product-safety law including the Virginia Graeme Baker Pool and Spa Safety Act; the CDC publishes the voluntary Model Aquatic Health Code; state and local health departments permit and inspect aquatic facilities; state amusement-ride safety programs (where they exist) inspect water slides; ASTM International publishes consensus standards (F2376 for water slides, F2461 for aquatic play); the PHTA and NRPA certify pool operators; lifeguard-certification bodies train staff; and the FTC and state Attorneys General enforce consumer protection. We cite specific frameworks when we describe procedures, but we are not a source of authoritative interpretation — the relevant body, or the park, is.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE U.S. LAW, we are not liable for any indirect, consequential, special, or incidental loss arising from your use of the site or your reliance on any content — specifically including but not limited to any loss arising from a booking made on the basis of out-of-date information, any cancelled or refused visit, any refused entry on a height/age/weight ground, any aspect of the visit itself, or any subsequent dispute with the park. Aggregate liability to any user is capped at one hundred U.S. dollars (US$100).
Nothing in this Disclaimer or our Terms of Use limits any liability that cannot be excluded under applicable U.S. law — including liability for personal injury caused by gross negligence, fraud, or anything else state law preserves. Your statutory consumer-protection rights under your state’s UDAP statute are unaffected.
